The plot has thickened further in a court case which seeks to validate the elections of various officials in the Football Kenya Federation (FKF) Nyamira county branch.
The disputed branch polls, held on 14th November, 2024 have now taken a new twist after it emerged that the former branch chairman Mr Luthers Mose Mokua interfered with the court process, changing the legal team and presenting an affidavit to court which has since been flagged as a forgery.
The winner of the Nyamira FKF chairmanship, which has been contested, Vincent Nyasani has called on the court sitting in Nyamira to dig deep to find the author of the affidavit as stakeholders seek to have the court grant their prayers and uphold the elections results.
The case took an unexpected turn when Mokua, purportedly acting on behalf of the FKF national office withdrew the services of the legal representative of the FKF Electoral board from the suit and instructed the law firm of Maeche and Company Advocates to take up the case.
Mokua is suspected to have forged an affidavit, allegedly signed by the FKF Electoral Board Chairman Hesbon Owila and purported to, on behalf of the electoral board, appoint a new law firm to litigate on the elections disputes.
In a letter to the High Court in Nyamira, the Electoral Board through its secretary Marcelline denied signing the affidavit terming it a forgery. “Our attention has been drawn to an affidavit sworn on 18th February, 2025,
purportedly by Dr. Hesbon Hansen Owilla,the chairman of the 2nd respondent,in connection with an application filed by the firm of Maeche &Company Advocates,” read the letter.
“We wish to categorically state that the 2nd Respondent,an independent body established under the Football Kenya Federation Constitution, did not authorize the swearing of this affidavit and disassociates itself entirely from it’s contents,” FKF EB continued.
“Furthermore, the signature appearing on the affidavit is a forgery and does not
belong to Dr.Hesbon Hansen Owilla, as evidenced by his attached letter affirming
the same. In light of this,we respectfully request that the said affidavit be expunged from the court records and that appropriate legal actions and sanctions be taken against those responsible for this fraudulent act,” The letter, copied to both the FKF President Hussein Mohammed and FIFA read.
Mokua, who is currently a member of the FKF finance committee has been fingered for making unilateral decisions at the federation with accusations that he has been carrying out procurement processes at FKF yet he is not an employee of the federation. The finance committee chairman has been buying various materials on behalf of FKF yet he is not officially allowed to transact business for or on behalf of the federation. Mokua has been reported to wield powers to even withdraw money from FKF accounts yet he is not a member of staff or an official signatory.
It is against this new found trappings of power that he instructed a different legal team in the Nyamira case in the pretext that it was the electoral board making the appointment. Mokua is an interested party in Nyamira, having been ousted from the executive before. In the run up to the FKF 2024 elections , Mokua fronted a team which failed to clinch any seats. The ousted county chairman had declared his desire to contest for the FKF Nyamira chairmanship but withdrew from the race and fronted a line up to challenge team blue candidates but all of them lost.
His line up was led by John Angwenyi who was contesting for chairmanship.
Mokua who had on 23rd December 2024 been barred by the sports disputes tribunal from in anyway associating himself with FKF Nyamira county office seems to be acting in contravention of valid and existing orders of the sports disputes tribunal.
Mokua was suspended as the Nyamira chairman for alleged gross misconduct, a motion that was passed by the Nyamira branch office and ratified by the past National Executive Committee. This prompted him to join the Hussein Mohammed team Fresh which eventually carried the day at the national level elections. Mokua has been in the past had allegations of forgery cases levelled against him in what many believe is a trend that has seen him dismissed by several of his previous employers.
