Governor Sakaja’s Officers Close Controversial Site in Parklands ahead of Court Contempt Sentencing

Nairobi City County Officers drawn from the lands and planning department have closed down the infamous construction at Taza Lane, 209/7509.

This comes weeks after the environment and lands court on 25/1/24, found Patrick Analo Akivaga (County Secretary, Nairobi County) Stephen Gathuita Mwangi (CECM-Nairobi County), Stephen Mwadime, Richard Mumo and Fredrick Ochanda (all Senior Officers at Lands and Urban Planning) to be in contempt of court orders for refusing to stop the on-going construction on 209/7549-Taza Lane, Parklands.

Court also found Ali Ibrahim Hamamed, Stella Nyamu, Yusuf Asker Mohamed, Arch. Salim Komora, Eng. Wilson Lepartobiko and Burach Koch to be in contempt of court orders for their continued construction activities on the said property.

They have all been ordered to personally appear in court on Monday 19/2/24 for mitigation and sentencing.

For years, locals have had hard time engaging with the developer who ignored court orders that asked him to stop the development of the building bragging of the protection from police officers, county and national government.

The developer, Ameey Homes through her agent Yusuf Asker has been threatening anyone attempting to distract the construction of the 16-storey building including area residents and journalists.

In a ruling read by Justice Angote in the presence of lawyers representing more than ten parties, he said that the court is satisfied that that the Applicants in the Petition that was filed in 2022 had established a prima facie case against the Respondents.

“Consequently the court orders that an interlocutory order of injunction be and is hereby made that the Respondents jointly and severally stop and enforce orders stopping the Interested Parties from undertaking any further development on L.R. No. 209/7549 Taza Lane,” said the Judge, adding that until a decision on the matter is made no development should go on.
